Stellicast Terms of Use

These Terms of Use ("Terms") govern your access to and use of Stellicast (the "Service"), including the website, web application, and any related features operated under the Stellicast name.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Stellicast.

Note: Stellicast is in early development and may be incomplete, unstable, or unavailable at times. Features may be added, changed, or removed without notice.


1. Who We Are

Stellicast is an in-development video streaming platform designed to be privacy-focused and community-driven.

  • "Stellicast", "we", "us", or "our" refers to the operator of the Service.
  • "You" or "user" refers to any person or entity that accesses or uses the Service.

2. Eligibility

To use the Service, you must:

  • Be at least the minimum age of digital consent in your jurisdiction (often 13 or 16 years old), or
  • Have permission from a parent or legal guardian if required by local law.

By using Stellicast, you represent and warrant that:

  • You are legally able to enter into these Terms, and
  • You are not prohibited from using the Service under any applicable law.

We may suspend or terminate your access if we believe you are ineligible or have violated these Terms.


3. Early-Stage Service Disclaimer

Stellicast is currently a work in progress. This means:

  • Features may be incomplete, experimental, or non-functional.
  • Data may be lost or changed due to ongoing development.
  • There is no guarantee of uptime, availability, or continued support.
  • We may change or remove any part of the Service at any time, with or without notice.
  • Accounts may be deleted at any time, with or without notice.

You use Stellicast at your own risk and understand that it is not yet a finished, production-ready platform.


4. Accounts and Security

4.1. Account Registration

To access certain features (now or in the future), you may need to create an account. When you register:

  • You must provide accurate, current, and complete information.
  • You are responsible for updating your information if it changes.

4.2. Account Security

You are responsible for:

  • Keeping your login credentials confidential.
  • All activity that occurs under your account, whether or not authorized by you.

If you suspect unauthorized use of your account, you must notify us promptly. We are not liable for any loss or damage arising from your failure to protect your account.


5. User Content

"User Content" means any content you submit, upload, publish, or otherwise make available through the Service, including but not limited to:

  • Videos, audio, images, and thumbnails
  • Titles, descriptions, tags, and metadata
  • Comments, reactions, and other text

5.1. Your Rights and License to Us

You retain any ownership rights you have in your User Content.

By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

  • Host, store, reproduce, modify (for technical purposes such as encoding, transcoding, or resizing), adapt, distribute, publicly display, and publicly perform your User Content,
  • For the purposes of operating, improving, promoting, and providing the Service.

This license continues for as long as your User Content is available on the Service. Certain copies may persist in backups or logs for a limited period even after deletion.

5.2. Your Responsibilities

You are solely responsible for your User Content and for the consequences of posting or sharing it. You represent and warrant that:

  • You have all necessary rights, licenses, and permissions to upload and share the content.
  • Your User Content does not infringe or violate the rights of any third party, including copyrights, trademarks, privacy rights, or other rights.

6. Prohibited Conduct

While Stellicast encourages free speech, you agree not to use the Service to:

  1. Break the law

    • Violate any applicable law, regulation, or court order.
    • Infringe or misappropriate any third-party rights (including copyright, trademark, or privacy rights).
  2. Upload harmful, abusive, or explicit content

    • Post content that is illegal, fraudulent, or deceptive.
    • Post content that is hateful, harassing, threatening, or that incites violence or harm.
    • Post sexually explicit content involving minors or any form of child sexual abuse material.
    • Post sexually explicit or suggestive content.
    • Post excessively graphic or violent content.
  3. Exploit or harm others

    • Engage in bullying, stalking, doxxing, or targeted harassment.
    • Impersonate any real person or entity or misrepresent your affiliation.
  4. Compromise security or integrity

    • Attempt to gain unauthorized access to the Service or other accounts.
    • Distribute malware, viruses, or malicious code.
    • Interfere with or disrupt the normal functioning of the Service.
  5. Circumvent technical measures

    • Bypass, disable, or otherwise interfere with security features or content protections without explicit permission from us.
    • Use automated systems (bots, scrapers) to access or collect data from the Service in a way that burdens our infrastructure or violates our policies.
  6. Misuse AI content

    • Misrepresent AI-generated content as entirely human-made where our policy requires disclosure.
    • Use AI or automation to mass-generate spam, low-quality content, or deceptive material.

We reserve the right—but not the obligation*—to review, moderate, or remove User Content or accounts that we believe violate these Terms or applicable law.

* While we will try our best to moderate content, we cannot guarantee that we will always be able to do so.


7. Content Moderation and Enforcement

We may enforce these Terms in various ways, including:

  • Removing or restricting access to specific content.
  • Limiting certain account features or functionality.
  • Suspending or terminating accounts or channels.
  • Reporting illegal content or activity to relevant authorities when required or appropriate.

Moderation decisions may involve human review, automated tools, or a combination of both. While we aim for fairness and transparency, we are not obligated to explain every individual moderation decision.*

* While we will try our best to explain in detail every moderation decision, we cannot guarantee that we always will be able to provide any more than a short reason for the termination.


8. Intellectual Property of Stellicast

The Service, including its:

  • Code, design, user interface, and layout,
  • Logos, branding, and trademarks,
  • Text, graphics, and other non-user content,

is owned by Stellicast or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Except as expressly allowed by these Terms or applicable law, you may not:

  • Copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part of it.
  • Use the Stellicast name, logo, or branding without prior written permission.

9. Third-Party Services and Links

Stellicast may use or link to third-party services, such as:

  • Authentication and backend providers
  • Content delivery networks (e.g., Bunny.net)
  • Hosting and infrastructure services
  • External websites, embeds, or integrations

We do not control and are not responsible for the content or privacy practices of third-party services. Your use of any third-party service is subject to that service's own terms and policies.


10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains:

  • What information we collect,
  • How we use, share, and store that information,
  • Your rights and choices regarding your data.

Please review the Privacy Policy carefully. By using the Service, you consent to our data practices as described there.


11. Beta Features and Changes to the Service

Because Stellicast is under active development:

  • Features may change, break, or disappear without notice.
  • Experimental or beta features may be offered with little or no documentation.
  • We may update, suspend, or discontinue any part of the Service at any time.

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service or any feature.


12. Disclaimers

To the fullest extent permitted by law:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
  • We make no warranties or representations, express or implied, including:
    • Warranties of merchantability,
    • Fitness for a particular purpose,
    • Non-infringement,
    • Or that the Service will be uninterrupted, secure, or error-free.

You bear all risk for your use of the Service.


13. Limitation of Liability

To the fullest extent permitted by law:

  • Stellicast and its owner(s), contributors, and affiliates will not be liable for:
    • Any indirect, incidental, special, consequential, or punitive damages,
    • Any loss of profits, data, goodwill, or other intangible losses,
    • Arising from or related to your use of or inability to use the Service.

Our total aggregate liability for any claims relating to the Service will not exceed the greater of:

  1. The amount you have paid to us (if any) in the 12 months preceding the claim, or
  2. $0 (zero), if you have not paid anything.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.


14. Indemnification

You agree to indemnify, defend, and hold harmless Stellicast and its owner(s), contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service,
  • Your User Content,
  • Your violation of these Terms, or
  • Your violation of any law or third-party rights.

15. Termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service, with or without notice, if we believe that:

  • You have violated these Terms, or
  • Your use poses a risk to the Service, other users, or third parties.

Upon termination:

  • Your right to access and use the Service will immediately cease.
  • Some provisions of these Terms will survive termination, including intellectual property, disclaimers, limitations of liability, and indemnification.

16. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will update the "Last updated" date at the top of this document.
  • For material changes, we may provide additional notice (e.g., a notice on the website or by email, if appropriate).

By continuing to use the Service after changes take effect, you agree to the updated Terms. If you do not agree, you must stop using Stellicast.


17. Governing Law and Dispute Resolution

These Terms and your use of the Service will be governed by and construed in accordance with the laws of:

  • Jurisdiction: Oklahoma, United States of America

without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in:

  • Venue: Tulsa, Oklahoma, United States of America

unless otherwise required by applicable law.


18. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any additional policies we publish, constitute the entire agreement between you and Stellicast regarding the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or other business transaction.
